Data Terms

Draft · pending legal review

This draft was prepared for product implementation and has not been reviewed by an attorney. It must be reviewed by qualified counsel before HomeCareIntent operates at broad commercial scale. Replace every bracketed placeholder before publishing.

Effective date: [Month Day, Year]
Last updated: [Month Day, Year]

These Data Terms govern how data obtained from HomeCareIntent may be used. They apply to paying customers (as part of the Terms of Service) and to anyone who uses or cites data from our public website, including the HomeCareIntent Market Index.

1. Independence and sources

HomeCareIntent is an independent company. We are not affiliated with or endorsed by any government agency, and nothing in our Services should be read as an official government record or statement.

Our data is derived from public records — such as state licensing and regulatory sources and federal datasets — and from third-party business data providers, combined with our own processing and analysis. Each signal in our product links to its public source where one exists. Our analysis (including intent scores, interpretations, and suggested sales angles) is labeled as HomeCareIntent interpretation and is not a source fact.

2. No warranty of accuracy; corrections

Public sources may be incomplete, outdated, or incorrect, and our processing may introduce errors. We provide data without any warranty of accuracy, completeness, or timeliness. Source update cadence and our check frequency are disclosed per jurisdiction and are not "real-time."

Corrections process: anyone may report an error using "Report incorrect data" on any record, or by emailing [corrections@homecareintent.com] with the record, the issue, the suggested correction, and any supporting evidence. We review reports in good faith, update or annotate displayed data when warranted, and preserve the original source history for auditability.

3. Permitted use (customers)

You may use data from the Services, within your plan limits, for:

  • Business-to-business prospecting — identifying, prioritizing, and contacting home care organizations about your products or services.
  • Market analysis — territory planning, market sizing, and internal reporting.
  • Importing exported data into your internal systems (for example, your CRM) for these purposes, accessible only to your personnel and contractors bound by confidentiality.

4. Prohibited uses

You may not use data from HomeCareIntent, directly or indirectly:

  1. For any purpose covered by the Fair Credit Reporting Act (FCRA) or similar laws, including as a factor in establishing any individual's eligibility for:

    HomeCareIntent is not a consumer reporting agency, and our data is not a consumer report.

    • consumer credit or other credit for personal, family, or household purposes;
    • employment, including hiring, promotion, reassignment, retention, or background screening of individuals;
    • insurance underwriting of individuals;
    • tenant screening or housing decisions;
    • any license or government benefit for an individual; or any other "permissible purpose" under the FCRA.
  2. To identify, target, contact, or market to patients, clients, care recipients, or their families, or to infer anyone's health condition or care needs.
  3. To make medical or care decisions.
  4. To resell, sublicense, publish, or redistribute data (in whole or substantial part, including derived lists) to third parties, or to build a competing dataset, without a written data license from us.
  5. To harass, stalk, or discriminate against any person, or for any unlawful purpose.
  6. To scrape, crawl, or bulk-copy our website or Services, or to circumvent rate limits, export limits, or access controls.
  7. To train machine-learning models for external commercial use or for redistribution, without a written license.

We may suspend or terminate access, without refund, for prohibited use.

5. Your compliance responsibilities

You are solely responsible for how you contact anyone using our data, including compliance with:

  • the Telephone Consumer Protection Act (TCPA) and FCC rules (including restrictions on autodialed or prerecorded calls and texts, and Do-Not-Call rules);
  • the CAN-SPAM Act and FTC rules for commercial email (including accurate header information, non-deceptive subject lines, a valid physical postal address, and a working opt-out honored promptly) — see the FTC's CAN-SPAM Act: A Compliance Guide for Business (opens in a new tab);
  • state telemarketing, privacy, and anti-spam laws; and
  • your own industry's rules.

Contact fields we provide (such as a company phone or public business email) do not indicate consent to be contacted by any channel. Honor all opt-out requests.

6. Individuals in business records

Some records name individuals in a business capacity (for example, an administrator or licensee). Use such information only to contact the organization about business matters. Do not use it for any purpose listed in Section 4, and honor any individual's request not to be contacted.

7. Public Market Index — citation and attribution

You may quote and cite aggregate statistics published on our public pages (for example, counts of new agencies in a state) in articles, research, presentations, and AI-generated answers, provided that you:

  • attribute clearly: "Source: HomeCareIntent Market Index ({page URL}), data as of {date}.";
  • link to the specific page cited where the medium allows;
  • do not alter the figures or present them as government statistics; and
  • include the as-of date.

You may not copy agency-level lists from our public pages in bulk, republish them, or use automated means to collect them. If you republish a HomeCareIntent research article with permission, include a canonical link to the original.

For larger extracts or research partnerships, contact [data@homecareintent.com].

8. Data licensing

Redistribution, resale, embedding in products, API access, and custom feeds require a separate written agreement (Enterprise / Data License). The terms of that agreement control where they conflict with these Data Terms.

9. After your subscription ends

You may retain data exported during an active subscription for your internal records and continue to use it consistent with Sections 3–6. You may not continue to receive updates or re-export data. On written request, you will certify deletion of data exported in violation of these Data Terms.

10. Changes

We may update these Data Terms with notice as described in the Terms of Service.
